Pune: Judicial Magistrate (First Class) A.A. Kulkarni of the Cantonment Court has granted bail to Hemant Bagreddy Motadu on a surety of ₹50,000. Motadu, a resident of Wanawadi, is accused of defrauding construction businessman Jayprakash Goyal in a land purchase and sale transaction.
Jayprakash Goyal had filed a complaint at Wanawadi police station, which led to charges against Hemant Motadu and notary Pramod Sharma.
Jayprakash Goyal had purchased land in Survey No. 751 at Wanawadi from Yasmin Faem Syed through a sale deed. The accused had prepared a power of attorney that could never be revoked with Reverend Father Morshlinsu Substetium Nyunas on June 26, 1997, and notarized it through Pramod Sharma on June 27, 1997.
In reality, Sharma obtained his license on July 21, 1997. Before Sharma received his license, he conspired with Hemant Motadu to create a forged power of attorney, applying fake seals to the document, and falsely certifying it as genuine, thereby defrauding the complainant.
Advocate Ameya Sirsikar represented the accused in court. He argued that the person from whom the complainant had bought the land was sentenced by the court in 2016 for forging the death will of the original owner, Reverend Father Morshlinsu Substetium Nyunas.
A civil case between the complainant and the accused has been pending for many years. In April 2017, the High Court ordered the status quo in the civil case.
Therefore, the complainant lodged this false complaint in October 2017 to turn the civil dispute into a criminal case and to pressurize the accused. The police have filed a final report in the matter.
Advocate Sirsikar also stated that the accused is willing to cooperate with the investigation. Considering these arguments, the court granted bail to Hemant Bagreddy Motadu under certain conditions.
