Will the Minor Be Declared an Adult?
The process of declaring a minor as an adult takes 60 to 90 days, after which a decision will be made. The police need to file an application with the board to declare any minor as an adult.
This application is considered, and a committee is formed to make the decision. Section 15 of the Juvenile Justice (Care and Protection) Act states that any child aged 16-18 involved in a heinous offense can be transferred to a criminal court, as defined in section 2(33) of the same act.
Advocate Prashant Patil, lawyer for the Agrawal family said, "The minor and his grandfather have been granted bail, while the bail application for Vishal and Shivani Agrawal is under review.
Vishal Agrawal has been granted bail for some offenses filed after the accident. Currently, they are in judicial custody for the blood sample tampering case. The investigation is ongoing."
Assistant Commissioner of Police (Crime Branch-1) and Investigating Officer Ganesh Ingle said, "The investigation is nearing completion, and a charge sheet will be filed soon. The remaining issues are being addressed with the accused.
New statements have been recorded against the minor, and a supplementary charge sheet will be filed. Additional sections have also been added to the charges. An application has been submitted to the Juvenile Justice Board to declare the minor an adult and initiate a criminal trial against him. Continuous follow-up is being done."
