Pune: The Bombay High Court has granted a petition filed by a Pune-based husband seeking the transfer of multiple legal claims filed by his wife to the Pune Family Court.
The wife had lodged separate claims against her husband and his family in different jurisdictions, which the court ruled was done with the intent to harass them.
Ramesh and Roma (names changed), who were living together in Pune with the husband's family after marriage, initially led a peaceful life. However, marital discord soon escalated, leading to frequent arguments. Eventually, Roma left for her parental home.
One day, without notice, she returned to their Pune residence, forcefully entered the home, and allegedly issued threats to her husband and his family. Feeling unsafe, the husband and his family vacated the house, prompting the husband to file for divorce in Pune’s Family Court.
Shortly afterward, the wife filed multiple legal cases against the husband and his family. Despite living in Pune, she filed a claim in Rahata, demanding to be taken back into the marital home. She also lodged a case in Kopargaon, accusing her husband and in-laws of domestic violence and demanding maintenance.
The husband, now having to appear in different courts, was represented by lawyers Adv. Amol Jagtap and Adv. Amit Rathi, who petitioned the High Court to consolidate all three claims into a single case heard in Pune.
The High Court, after reviewing the situation, approved the petition and directed that all claims be transferred to the Pune Family Court. This decision provided relief to the husband and his family, who were being dragged into different legal battles across multiple locations.
Adv. Amit Rathi, representing the husband, stated that the wife’s intention was to trouble her husband and his family by filing claims in various jurisdictions, even though she lived in Pune.
The court, recognizing the undue hardship placed on the husband and his family, ruled in favor of consolidating the cases.
