Family Court Finalizes Mutual Consent Divorce Case in Two Months

Pune: A mutual consent divorce petition was swiftly resolved by the family court within five sessions over nearly two months.

The husband agreed to provide the marital home to his wife and paid a lump sum alimony, leading to the settlement of the case.

The couple had been living separately for over 18 months, and mediation attempts by family members were unsuccessful. With the conditions for divorce met, Family Court Chief Judge Manisha Kale promptly concluded the case.

The couple, both highly educated, faced ongoing disputes due to differences in opinions, personalities, and hobbies. Married in 1998, they decided to separate and filed for divorce through Advocate Aarti K. Joshi on April 15. The case was resolved by June 20.

Their marriage took place in Goa but was initially not registered there. Although they later registered their marriage, the unique registration procedures in Goa meant that the divorce could only be obtained there.

However, Advocate Joshi successfully argued that the local court had jurisdiction over the case, allowing it to be handled in Pune.

Advocate Aarti K. Joshi, Lawyer for the Petitioning Husband and Wife, said, "The couple decided to separate by mutual consent after being unable to reconcile their differences.

They had been living apart for more than 18 months before filing the petition. The conditions and terms of the divorce were met, and necessary counseling and discussions were held. Considering all these aspects, the court finalized the case."
