Partner Unwilling to Return to India from Abroad Leading to Divorce Cases
Pune: After moving to the United States, we're going to stay there for 10 years. We then went to the US on the condition that we would come back to India and stay here.
But after 10 years, my wife did not want to come back to India. She wanted to stay there with the kids. But even though I had told her earlier, she was not ready to come again. I filed for divorce here because of the controversy that ensued. She agreed and we parted ways.
This is the story of Ashok, who returned to India after working in the IT sector in the US for a few years. Ashok's wife Rekha (all names changed) refused to come back to India and has settled in the US with her children.
The same thing is happening with many couples right now. There have been several cases of divorce as one of the two partners is not ready to come back to India.
Many couples move abroad for a certain period of time or to settle down due to job opportunities abroad, the possibility of higher wages or business growth there, and the attraction of the lifestyle there.
Some couples get into arguments after the expiry of the scheduled period or when the couple starts talking about coming back to India for some unavoidable reasons.
One partner wants to stay abroad while the other wants to return home. There have been several instances in the family court here where the matter goes to court and the couple separates after a heated argument.
This leads to controversy:
- A Companion Doesn't Want to Come Back
- A partner is not willing to wait until the child is educated
- Partner's sudden decision to return due to unavoidable reasons
This does not bring back the companions:
- Preferred lifestyle abroad
-increment
- Citizenship
- Children's education has not been completed
- Good job opportunities have been created
If one partner is not ready to come back, the other partner comes here and files a suit against it. The other partner then appears here or makes his case online.
Often, another partner fights a court battle with a power of attorney. He is giving a statement through video conferencing of his colleague who is abroad. The couple were independent by completing the procedures required by case.
Differences in the thinking of husband and wife. A comparison of life there and here. Also, many couples who are abroad have disputes when coming back to India, taking into account many factors such as salary, responsibilities, time and freedom.
In many cases, money has also been shown to be given more importance than relationships. One of the companions leaves and the other seems to be staying there.
Eventually, there has been an increase in cases where the case is going to court, said Adv. Sunita Jangam, an advocate practicing law in the family court.
